Ordinance 318 Section 14 – Nuisance Dogs to go into effect May 1st.

Ordinance is as follows…

It is a public nuisance for any dog to chase vehicles on a town street, road-way, or park, to run at large or to be owned, kept or maintained without a current immunization against rabies, distemper, or parvo virus.

Every person having under his control any female dog in heat shall ensure such dog is kept in a confined area not accessible to male animals which may be running at large. Failure to confine such female dog constitutes a public nuisance.

Any dog that destroys property, injures or destroys other pets or other animals not trespassing on the property of or attempting to injure or injuring the person, family, or property owner, is classified as a nuisance.

Maintenance, harboring or keeping of any dog which by loud and continuing barking, howling or yelping interferes with the comfortable enjoyment of life or property by the community, neighbor, or by a number of persons is also maintaining a public nuisance.

Any person who allows any dog owned, subject to his maintenance or custody, to be kept in a manner which constitutes a public nuisance, is guilty of a misdemeanor.

The reasonable man standard shall be applied in all cases. “Reasonable man” is defined as the normal healthy person of ordinary habits and sensibilities who is entitled to enjoy ordinary comfort of human existence and not the extra sensitive or fastidious person or the hardened individual inured to such irritation or annoyance.
